Your spouse is already in Canada. Maybe they entered as a visitor, worker or student. You are living together and now want to start the permanent residence process.

A common question is: “Do they have to leave Canada before I can sponsor them?”

Not necessarily. But the correct sponsorship route and the spouse's temporary status both matter.

Two Important Issues: PR and Temporary Status

Spousal sponsorship is a permanent residence process. Your spouse's visitor, worker or student status is a separate temporary-residence issue.

IRCC specifically says a person waiting for permanent residence can remain in Canada only as long as they maintain legal temporary status.

Spouse or Common-Law Partner in Canada Class

For this class, the sponsored spouse or partner generally needs to be living in Canada with the sponsor. The relationship must be genuine and the applicant must meet the applicable requirements.

Family Class Can Also Matter

Depending on the circumstances, a spouse who is in Canada may still be sponsored through the Family Class. The best route can depend on travel needs, status, where the couple is living and other case-specific considerations.

⚠️ Mistake #1: Assuming the PR Application Extends Visitor Status

Submitting a sponsorship application does not automatically extend a visitor record, study permit or work permit. Temporary status has to be managed separately.

⚠️ Mistake #2: Ignoring Travel Plans

If an applicant leaves Canada while an in-Canada application is processing, there can be practical risks if they are unable to return. Travel should be considered before choosing a strategy.

⚠️ Mistake #3: Waiting Until Status Is About to Expire

Do not wait until the last day to think about status. Review the expiry date, whether an extension is needed and whether an open work permit may be available after the sponsorship reaches the required stage.

💡 CANBRIDGE LEGAL TIP

Think of the file as two tracks running together:

Track 1: Permanent residence through sponsorship.
Track 2: Maintaining valid temporary status while the PR application is processed.

Ignoring either track can create avoidable problems.
