💼 Spousal Sponsorship + Open Work Permit: What Couples in Canada Should Know- CANBRIDGE LEGAL INSIGHTS

For many couples, the immigration question is not only “When will PR be approved?” It is also: “Can my spouse work while we wait?”

IRCC has an open work permit option for certain sponsored spouses, partners and accompanying dependent children who are living in Canada.

Who May Be Able to Apply?

For a principal applicant, IRCC currently requires that the person be in a genuine relationship with the sponsor, be included in a permanent residence application that has received an acknowledgement of receipt (AOR), and be living in Canada with the sponsor.

Why the AOR Matters

An AOR is more than a submission receipt. It means IRCC has reviewed the application package and confirmed that it is complete enough to enter processing.

For this open work permit route, the correct AOR is an important eligibility step.

⚠️ Mistake #1: Applying Too Early

If the required AOR has not been issued, the applicant may not yet meet the published requirement for this open work permit category.

⚠️ Mistake #2: Confusing PR Status With Temporary Status

A pending sponsorship application is not itself permission to work. Working without authorization can create serious immigration issues.

⚠️ Mistake #3: Assuming Every Sponsored Spouse Qualifies

Eligibility depends on the applicant's circumstances, where they are living, the sponsorship file and other immigration requirements. Do not assume a friend's timeline or permit route automatically applies to you.

💡 CANBRIDGE LEGAL TIP

Do not begin unauthorized work because “the PR is already filed.”

Confirm the person's current status and work authorization first. Permanent residence and work authorization are separate legal questions.
